Tassie Same Sex Marriage Bill defeated

The Tasmanian Upper House has voted against a same-sex marriage bill.  The Lower House had become the first Australian parliament to pass a bill to legalise same-sex marriage. The bill was co-sponsored by Premier Lara Giddings and Greens leader Nick McKim.

State Homosexual Marriage Laws Unconstitutional

Murdoch University senior lecturer in constitutional law and associate dean (research) Augusto Zimmermann reports in News Weekly (Oct 13 2012) that the push by Labor and the Greens to introduce same sex “marriage” laws in State Parliament is unconstitutional. He writes that any such legislation would be subject to disallowance by the High Court as the Australian Constitution gives the Commonwealth parliament authority to makes laws with respect to marriage. Marriage Bill defeated

The first federal vote to change the Marriage Act was defeated on Sept 19, 2012 in the House of Representatives 98 votes to 42 votes. Those who voted in favour of same-sex marriage included the member for Brand, Gary Gray and member for Fremantle, Melissa Parke. For full voting list click here.
